ผู้บริหารอสังหาฯ จึงขอให้กองทุนรวมดำเนินการให้ธนาคารพาณิชย์ที่กองทุนรวมมีเงินฝากอยู่ทำการออก bank guarantee ให้แก่ผู้บริหารอสังหาฯ เพื่อให้ธนาคาร รับผิดชอบค่าใช้จ่าย
(1) กองทุนรวมต้องมีลักษณะเป็นไปตาม Memorandum of Cooperation on the Establishment and Implementation of the Asia Region Funds Passport (“MOC”) (2) บลจ. ได้
) ประเภท Signatory A ใน Multilateral Memorandum of Understanding Concerning Consultation and Cooperation and the Exchange of Information (MMOU) หรือเปิดบัญชีเพื่อการลงทุนในประเทศดังกล่าว
เงินค่าเช่าที่จะจ่ายให้กอง และเป็นคนวางหลักประกัน เช่น เนื่องจากเป็นเพียงการปฏิบัติตาม bank guarantee แต่ไม่มีบุคคลอื่นมาชดเชย

ลายลักษณ์อักษรและสามารถบังคับได้ตามกฎหมาย (explicit guarantee) ในกรณีที่เป็นแหล่งเงินทุนรองรับความเสี่ยงด้านสภาพคล่อง ทรัพย์สินตามวรรคหนึ่งให้รวมถึงสินเชื่อที่ได้รับจากธนาคารพาณิชย์ก็ได้
